Narrated Urwa bin Ja'd:
The Prophet (ﷺ) said, "Good will remain (as a permanent quality) in the foreheads of horses till the Day of Resurrection."

Narrated `Urwa Al-Bariqi:
The Prophet (ﷺ) said, "Good will remain (as a permanent quality) in the foreheads of horses (for Jihad) till the Day of Resurrection, for they bring about either a reward (in the Hereafter) or (war) booty (in this world)."

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا سُفْيَانُ، عَنْ إِبْرَاهِيمَ بْنِ مَيْسَرَةَ، سَمِعْتُ عَمْرَو بْنَ الشَّرِيدِ، قَالَ جَاءَ الْمِسْوَرُ بْنُ مَخْرَمَةَ فَوَضَعَ يَدَهُ عَلَى مَنْكِبِي، فَانْطَلَقْتُ مَعَهُ إِلَى سَعْدٍ فَقَالَ أَبُو رَافِعٍ لِلْمِسْوَرِ أَلاَ تَأْمُرُ هَذَا أَنْ يَشْتَرِيَ مِنِّي بَيْتِي الَّذِي فِي دَارِي‏.‏ فَقَالَ لاَ أَزِيدُهُ عَلَى أَرْبَعِمِائَةٍ، إِمَّا مُقَطَّعَةٍ وَإِمَّا مُنَجَّمَةٍ‏.‏ قَالَ أُعْطِيتُ خَمْسَمِائَةٍ نَقْدًا، فَمَنَعْتُهُ، وَلَوْلاَ أَنِّي سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم يَقُولُ ‏‏ الْجَارُ أَحَقُّ بِصَقَبِهِ ‏"‏‏‏ مَا بِعْتُكَهُ أَوْ قَالَ مَا أَعْطَيْتُكَهُ‏‏ قُلْتُ لِسُفْيَانَ إِنَّ مَعْمَرًا لَمْ يَقُلْ هَكَذَا‏‏ قَالَ لَكِنَّهُ قَالَ لِي هَكَذَا‏‏ وَقَالَ بَعْضُ النَّاسِ إِذَا أَرَادَ أَنْ يَبِيعَ الشُّفْعَةَ فَلَهُ أَنْ يَحْتَالَ حَتَّى يُبْطِلَ الشُّفْعَةَ فَيَهَبُ الْبَائِعُ لِلْمُشْتَرِي الدَّارَ، وَيَحُدُّهَا وَيَدْفَعُهَا إِلَيْهِ، وَيُعَوِّضُهُ الْمُشْتَرِي أَلْفَ دِرْهَمٍ، فَلاَ يَكُونُ لِلشَّفِيعِ فِيهَا شُفْعَةٌ‏‏
Narrated 'Amr bin Ash-Sharid:
Al-Miswar bin Makhrama came and put his hand on my shoulder and I accompanied him to Sa'd. Abu Rafi' said to Al-Miswar, "Won't you order this (i.e. Sa'd) to buy my house which is in my yard?" Sa'd said, "I will not offer more than four hundred in installments over a fixed period." Abu Rafi said, "I was offered five hundred cash but I refused. Had I not heard the Prophet (ﷺ) saying, 'A neighbor is more entitled to receive the care of his neighbor,' I would not have sold it to you." The narrator said, to Sufyan: Ma'mar did not say so. Sufyan said, "But he did say so to me." Some people said, "If someone wants to sell a house and deprived somebody of the right of preemption, he has the right to play a trick to render the preemption invalid. And that is by giving the house to the buyer as a present and marking its boundaries and giving it to him. The buyer then gives the seller one-thousand Dirham as compensation in which case the preemptor loses his right of preemption."

وَحَدَّثَنِي أَبُو الرَّبِيعِ الزَّهْرَانِيُّ، حَدَّثَنَا حَمَّادٌ، عَنِ الزُّبَيْرِ بْنِ الْخِرِّيتِ، عَنْ عَبْدِ اللَّهِ بْنِ شَقِيقٍ، قَالَ خَطَبَنَا ابْنُ عَبَّاسٍ يَوْمًا بَعْدَ الْعَصْرِ حَتَّى غَرَبَتِ الشَّمْسُ وَبَدَتِ النُّجُومُ وَجَعَلَ النَّاسُ يَقُولُونَ الصَّلاَةَ الصَّلاَةَ - قَالَ - فَجَاءَهُ رَجُلٌ مِنْ بَنِي تَمِيمٍ لاَ يَفْتُرُ وَلاَ يَنْثَنِي الصَّلاَةَ الصَّلاَةَ ‏.‏ فَقَالَ ابْنُ عَبَّاسٍ أَتُعَلِّمُنِي بِالسُّنَّةِ لاَ أُمَّ لَكَ ‏.‏ ثُمَّ قَالَ رَأَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم جَمَعَ بَيْنَ الظُّهْرِ وَالْعَصْرِ وَالْمَغْرِبِ وَالْعِشَاءِ ‏.‏ قَالَ عَبْدُ اللَّهِ بْنُ شَقِيقٍ فَحَاكَ فِي صَدْرِي مِنْ ذَلِكَ شَىْءٌ فَأَتَيْتُ أَبَا هُرَيْرَةَ فَسَأَلْتُهُ فَصَدَّقَ مَقَالَتَهُ ‏.‏
Abdullah b. Shaqiq reported:
Ibn 'Abbas one day addressed us in the afternoon (after the afternoon prayer) till the sun disappeared and the stars appeared, and the people began to say: Prayer, prayer. A person from Banu Tamim came there. He neither slackened nor turned away, but (continued crying): Prayer, prayer. Ibn 'Abbas said: May you be deprived of your mother, do you teach me Sunnah? And then he said: I saw the Messenger of Allah (ﷺ) combining the noon and afternoon prayers and the sunset and 'Isha' prayers. 'Abdullah b. Shaqiq said: Some doubt was created in my mind about it. So I came to Abu Huraira and asked him (about it) and he testified his assertion.

حَدَّثَنَا مُسَدَّدٌ، وَمُحَمَّدُ بْنُ الْعَلاَءِ، قَالاَ حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنِ الأَعْمَشِ، عَنْ أَبِي وَائِلٍ، عَنْ مَسْرُوقٍ، عَنْ عَائِشَةَ، قَالَتْ مَا تَرَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم دِينَارًا وَلاَ دِرْهَمًا وَلاَ بَعِيرًا وَلاَ شَاةً وَلاَ أَوْصَى بِشَىْءٍ ‏.‏
Narrated 'Aishah:
The Messenger of Allah (ﷺ) did not leave dinars, dirhams, camels and goats, nor did he leave will for anything.

حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدٍ الْمَرْوَزِيُّ، حَدَّثَنِي عَلِيُّ بْنُ حُسَيْنِ بْنِ وَاقِدٍ، عَنْ أَبِيهِ، عَنْ يَزِيدَ النَّحْوِيِّ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، ‏{‏ إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ ‏}‏ فَكَانَتِ الْوَصِيَّةُ كَذَلِكَ حَتَّى نَسَخَتْهَا آيَةُ الْمِيرَاثِ ‏.‏
Narrated Ibn 'Abbas:
The Qur'anic verse goes: "(It is prescribed when death approaches any of you), if he leaves any goods, that he may bequest to parents and next to kin." The bequest was made in this way until the verse of inheritance repealed it.

حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلاَءِ، حَدَّثَنَا وَكِيعٌ، وَأَبُو مُعَاوِيَةَ عَنِ الأَعْمَشِ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَ حَدِيثِ شُعْبَةَ عَنِ الأَعْمَشِ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ صَحِيحٌ وَهُوَ أَصَحُّ مِنَ الْحَدِيثِ الأَوَّلِ ‏.‏ هَكَذَا رَوَى غَيْرُ وَاحِدٍ هَذَا الْحَدِيثَ عَنِ الأَعْمَشِ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ وَرَوَى مُحَمَّدُ بْنُ عَجْلاَنَ عَنْ سَعِيدٍ الْمَقْبُرِيِّ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏‏ مَنْ قَتَلَ نَفْسَهُ بِسُمٍّ عُذِّبَ فِي نَارِ جَهَنَّمَ ‏"‏ ‏‏ وَلَمْ يَذْكُرْ فِيهِ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا ‏‏ وَهَكَذَا رَوَاهُ أَبُو الزِّنَادِ عَنِ الأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم وَهَذَا أَصَحُّ لأَنَّ الرِّوَايَاتِ إِنَّمَا تَجِيءُ بِأَنَّ أَهْلَ التَّوْحِيدِ يُعَذَّبُونَ فِي النَّارِ ثُمَّ يُخْرَجُونَ مِنْهَا وَلَمْ يُذْكَرْ أَنَّهُمْ يُخَلَّدُونَ فِيهَا ‏‏

حَدَّثَنَا مُحَمَّدُ بْنُ مَدُّويَهْ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ حَمَّادٍ الشُّعَيْثِيُّ، حَدَّثَنَا عَبَّادُ بْنُ مَنْصُورٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏‏ إِنَّ خَيْرَ مَا تَدَاوَيْتُمْ بِهِ السَّعُوطُ وَاللَّدُودُ وَالْحِجَامَةُ وَالْمَشِيُّ ‏"‏ ‏.‏ فَلَمَّا اشْتَكَى رَسُولُ اللَّهِ صلى الله عليه وسلم لَدَّهُ أَصْحَابُهُ فَلَمَّا فَرَغُوا قَالَ ‏"‏ لُدُّوهُمْ ‏"‏ ‏.‏ قَالَ فَلُدُّوا كُلُّهُمْ غَيْرَ الْعَبَّاسِ ‏.‏"
Ibn 'Abbas narrated that the Messenger of Allah (ﷺ) said:
"Indeed the best of what you treat is As-Sa'ut, Al-Ladud, cupping and laxatives.' So when the Messenger of Allah (ﷺ) was suffering his companions treated him with Al-Ladud, and when they were finished he said: 'Treat them with Al-Ladud.' So all of them except Al-Abbas were treated with Al-Ladud."

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا عَبَّادُ بْنُ مَنْصُورٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏‏ إِنَّ خَيْرَ مَا تَدَاوَيْتُمْ بِهِ اللَّدُودُ وَالسَّعُوطُ وَالْحِجَامَةُ وَالْمَشِيُّ وَخَيْرُ مَا اكْتَحَلْتُمْ بِهِ الإِثْمِدُ فَإِنَّهُ يَجْلُو الْبَصَرَ وَيُنْبِتُ الشَّعْرَ ‏"‏ ‏‏ قَالَ وَكَانَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم مُكْحُلَةٌ يَكْتَحِلُ بِهَا عِنْدَ النَّوْمِ ثَلاَثًا فِي كُلِّ عَيْنٍ ‏‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ وَهُوَ حَدِيثُ عَبَّادِ بْنِ مَنْصُورٍ ‏‏
Ibn 'Abbas narrated that the Messenger of Allah (ﷺ) said:
"Indeed the best of what you treat is As-Sa'ut, Al-Ladud, cupping and laxatives.' And the best of what you use for Kuhl is Ithmid, for it clears the vision and grows the hair (eye-lashes)." And he said:" The Messenger of Allah (ﷺ) had a Kuhl holder with which he would apply Kuhl before sleeping three in each eye."

أَخْبَرَنِي مُحَمَّدُ بْنُ وَهْبٍ، قَالَ حَدَّثَنِي مُحَمَّدُ بْنُ سَلَمَةَ، قَالَ حَدَّثَنِي أَبُو عَبْدِ الرَّحِيمِ، قَالَ حَدَّثَنِي زَيْدُ بْنُ أَبِي أُنَيْسَةَ، عَنْ أَبِي إِسْحَاقَ، عَنْ أَبِي عَبْدِ الرَّحْمَنِ السُّلَمِيِّ، قَالَ لَمَّا حُصِرَ عُثْمَانُ فِي دَارِهِ اجْتَمَعَ النَّاسُ حَوْلَ دَارِهِ - قَالَ - فَأَشْرَفَ عَلَيْهِمْ ‏.‏ وَسَاقَ الْحَدِيثَ ‏.‏
It was narrated that 'Abdur-Rahman Al-Sulami said:
"When 'Uthman was besieged in his house, the people gathered around his house and he looked out over them" and he quoted the same Hadith.

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ، قَالَ حَدَّثَنَا يَحْيَى، قَالَ حَدَّثَنَا شُعْبَةُ، عَنْ قَتَادَةَ، عَنْ مُطَرِّفٍ، عَنْ أَبِيهِ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏‏ ‏{‏أَلْهَاكُمُ التَّكَاثُرُ * حَتَّى زُرْتُمُ الْمَقَابِرَ‏}‏ قَالَ يَقُولُ ابْنُ آدَمَ مَالِي مَالِي وَإِنَّمَا مَالُكَ مَا أَكَلْتَ فَأَفْنَيْتَ أَوْ لَبِسْتَ فَأَبْلَيْتَ أَوْ تَصَدَّقْتَ فَأَمْضَيْتَ ‏"‏‏.‏"
It was narrated from Mutarrif, from his father, that the Prophet said:
"The mutual rivalry (for piling up of worldly things) diverts you, 'Until you visit the graves (i.e. till you die).' The son of Adam says: 'My wealth, my wealth,' but your wealth is what you eat and consume, or what you wear and it wears out, or what you give in charity and send on ahead (for the Hereafter).'"

أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الأَعْلَى، قَالَ أَنْبَأَنَا ابْنُ وَهْبٍ، قَالَ أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، قَالَ فَإِنَّ سَالِمًا أَخْبَرَنِي عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏‏ مَا حَقُّ امْرِئٍ مُسْلِمٍ تَمُرُّ عَلَيْهِ ثَلاَثُ لَيَالٍ إِلاَّ وَعِنْدَهُ وَصِيَّتُهُ ‏"‏‏‏ قَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ مَا مَرَّتْ عَلَىَّ مُنْذُ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ذَلِكَ إِلاَّ وَعِنْدِي وَصِيَّتِي‏‏
It was narrated from 'Abdullah bin 'Umar that the Prophet said:
"It is not befitting for a Muslim to abide for three nights without having his will with him." 'Abdullah bin 'Umar said: "Since I heard this from the Messenger of Allah, I have always had my will with me."

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، حَدَّثَنَا أَبُو خَالِدٍ الأَحْمَرُ، عَنْ حَجَّاجٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ حُوَيِّصَةَ، وَمُحَيِّصَةَ، ابْنَىْ مَسْعُودٍ وَعَبْدَ اللَّهِ وَعَبْدَ الرَّحْمَنِ ابْنَىْ سَهْلٍ خَرَجُوا يَمْتَارُونَ بِخَيْبَرَ فَعُدِيَ عَلَى عَبْدِ اللَّهِ فَقُتِلَ فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ ‏‏ تُقْسِمُونَ وَتَسْتَحِقُّونَ ‏"‏ ‏.‏ فَقَالُوا يَا رَسُولَ اللَّهِ كَيْفَ نُقْسِمُ وَلَمْ نَشْهَدْ قَالَ ‏"‏ فَتُبْرِئُكُمْ يَهُودُ ‏"‏ ‏.‏ قَالُوا يَا رَسُولَ اللَّهِ إِذًا تَقْتُلُنَا ‏.‏ قَالَ فَوَدَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْ عِنْدِهِ ‏.‏"
It was narrated from 'Amr bin Shu'aib, from his father, from his grandfather, that :
Huwayyisah and Muhayyisah , the sons of Mas'ud, and 'Abdullah and 'Abdur-Rahman the sons of Sahl, went out to search for food in Khaibar. 'Abdullah was attacked and killed, and mention of that was made to the Messenger of Allah (ﷺ). He said: "Will you swear an oath and establish your right to blood money?" They said: "O Messenger of Allah (ﷺ), how can we swear an oath when we did not witness anything?" He said: "Do you want the Jews to swear that they are innocent?" They said: "O Messenger of Allah (ﷺ), then they will kill us too." So the Messenger of Allah (ﷺ) paid the blood money himself.

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مَعْدِيُّ بْنُ سُلَيْمَانَ، أَنْبَأَنَا ابْنُ عَجْلاَنَ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏‏ مَنْ قَتَلَ مُعَاهِدًا لَهُ ذِمَّةُ اللَّهِ وَذِمَّةُ رَسُولِهِ لَمْ يَرَحْ رَائِحَةَ الْجَنَّةِ وَإِنَّ رِيحَهَا لَيُوجَدُ مِنْ مَسِيرَةِ سَبْعِينَ عَامًا ‏"‏ ‏‏
It was narrated from Abu Hurairah that the Prophet (ﷺ) said:
"Whoever kills a Mu'ahid who has the protection of Allah and the protection of his Messenger, will not smell the fragrance of Paradise, even though its fragrance may be detected from a distance of Seventy years."

وعن واثلة بن الأسقع رضي الله عنه قال‏:‏ صلى بنا رسول الله صلى الله عليه وسلم علي رجل من المسلمين، فسمعته يقول‏:‏ ‏‏اللهم إن فلان ابن فلان في ذمتك وحبل جوارك، فقه فتنة القبر، وعذاب النار، وأنت أهل الوفاء والحمد؛ اللهم اغفر له وارحمه، إنك أنت الغفور الرحيم‏"‏ ‏(‏‏(‏رواه أبو داود‏)‏‏)‏‏‏
Wathilah bin Al-Asqa' (May Allah be pleased with him) reported:
The Messenger of Allah (ﷺ) led the funeral prayer of a Muslim man in our presence, and I heard him saying "Allahumma inna

[name of the dead person] fi dhimmatika wa habli jiwarika, faqihi fitnatal- qabri; wa 'adhaban-Nari, wa Anta ahlul-wafa'i wal-hamdi; Allahumma faghfir lahu warhamhu, innaka Antal-Ghafur-ur-Rahim

[If the dead person is a woman, one can change hu in some words here with ha]

[O Allah, (so-and-so son of so-and-so) is in Your Protection and inside the surroundings of Your Refuge. Safeguard him from the trial of the grave and the punishment of the Hell. You keep Your Promise and You deserve to be praised. O Allah! Forgive him and be merciful to him. Indeed, You are the Forgiving, the Merciful]."

وعن عبد الله بن أبي أوفي رضي الله عنهما أنه كبر علي جنازة ابنة له أربع تكبيرات، فقام بعد الرابعة كقدر ما بين التكبيرتين يستغفر لها ويدعو، ثم قال‏:‏ كان رسول الله صلى الله عليه وسلم يصنع هكذا‏.‏ وفي رواية‏:‏ ‏ ‏كبر أربعاً، فمكث ساعة حتي ظننت أنه سيكبر خمساً، ثم سلم عن يمينه وعن شماله‏.‏ فلما انصرف قلنا له‏:‏ ما هذا‏؟‏ فقال‏:‏ إني لا أزيدكم علي ما رأيت رسول الله صلى الله عليه وسلم يصنع، أو‏:‏ هكذا صنع رسول الله صلى الله عليه وسلم ‏ ‏ ‏(‏‏(‏رواه الحاكم وقال‏:‏ حديث صحيح‏)‏‏)‏‏.‏
Abdullah bin Abu Aufa (May Allah be pleased with them) reported:
While offering the funeral prayer of one of his daughters, he recited four Takbir, and after the fourth Takbir he continued standing for a time equal to an interval between two Takbir, praying for her and seeking Allah's forgiveness for her." Then he said: "The Messenger of Allah (ﷺ) used to do so."

Another narration is: He (Abdullah) recited four Takbir and remained standing in prayer for some time till we thought that he would recite the fifth Takbir. Then he gave Salam on the right and on the left. When he turned aside, we asked him about it. He replied: "I would add nothing to what I saw the Messenger of Allah (ﷺ) doing," or he said: "The Messenger of Allah (ﷺ) used to do so."

عن أبي هريرة رضي الله عنه عن النبي صلى الله عليه وسلمى الله عليه وسلم الله عليه وسلم الله عليه وسلم قال‏:‏ ‏‏أسرعوا بالجنازة، فإن تك صالحة، فخير تقدمونها إليه، وإن تك سوي ذلك، فشر تضعونه عن رقابكم‏"‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏‏.‏ ‏(‏‏(‏وفي رواية لمسلم‏:‏ ‏"‏فخير تقدمونها عليه‏)‏‏)‏‏.‏"
Abu Hurairah (May Allah be pleased with him) reported:
I heard the Prophet (ﷺ) saying, "Hurry up with the dead body (for its burial), for if it is pious, you are speeding it to goodness and if it is otherwise, you are laying an evil off your necks."

Malik Muwatta
Yahya said that Malik spoke about a man who died and had a debt owing to him and there was one witness, and some people had a debt against him and they had only one witness, and his heirs refused to take an oath on their rights with their witness. He said, "The creditors take an oath and take their rights. If there is anything left over, the heirs do not take any of it. That is because the oaths were offered to them before and they abandoned them, unless they say, 'We did not know that our companion had extra,' and it is known that they only abandoned the oaths because of that. I think that they should take an oath and take what remains after his debt."

قَالَ يَحْيَى قَالَ مَالِكٌ عَنْ جَمِيلِ بْنِ عَبْدِ الرَّحْمَنِ الْمُؤَذِّنِ، أَنَّهُ كَانَ يَحْضُرُ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ وَهُوَ يَقْضِي بَيْنَ النَّاسِ فَإِذَا جَاءَهُ الرَّجُلُ يَدَّعِي عَلَى الرَّجُلِ حَقًّا نَظَرَ فَإِنْ كَانَتْ بَيْنَهُمَا مُخَالَطَةٌ أَوْ مُلاَبَسَةٌ أَحْلَفَ الَّذِي ادُّعِيَ عَلَيْهِ وَإِنْ لَمْ يَكُنْ شَىْءٌ مِنْ ذَلِكَ لَمْ يُحَلِّفْهُ ‏.‏ قَالَ مَالِكٌ وَعَلَى ذَلِكَ الأَمْرُ عِنْدَنَا أَنَّهُ مَنِ ادَّعَى عَلَى رَجُلٍ بِدَعْوَى نُظِرَ فَإِنْ كَانَتْ بَيْنَهُمَا مُخَالَطَةٌ أَوْ مُلاَبَسَةٌ أُحْلِفَ الْمُدَّعَى عَلَيْهِ فَإِنْ حَلَفَ بَطَلَ ذَلِكَ الْحَقُّ عَنْهُ وَإِنْ أَبَى أَنْ يَحْلِفَ وَرَدَّ الْيَمِينَ عَلَى الْمُدَّعِي فَحَلَفَ طَالِبُ الْحَقِّ أَخَذَ حَقَّهُ ‏.‏
Yahya said, "Malik said about Jamil ibn Abd ar-Rahman al-Muadhdin that he was present with Umar ibn Abd al-Aziz when he was judging between people. If a man came to him with a claim against a man, he examined whether or not there were frequent transactions and dealings between them. If there were, the defendant could make an oath. If there was nothing of that nature he did not accept an oath from him."

Malik summed up, "What is done in our community is that if some one makes a claim against a man, it is examined. If there are frequent transactions and dealings between them, the defendant is made to take an oath. If he takes an oath, the claim against him is dropped. If the defendant refuses to take an oath, and returns the oath to the claimant, the one claiming his right takes an oath and takes his due."
